Terms of Service

1. Overview

These Terms of Service ("Terms") govern the purchase and use of website design products and services provided by P-two 3 Studio ("we", "us", "our"). By placing an order through our website, you ("the Customer", "you") agree to be bound by these Terms.

2. Products & Services

P-two 3 Studio provides pre-designed website themes that are customised based on information you provide through our guided prompt system. Each order results in a complete set of website files (HTML, CSS, JavaScript, images, and associated assets) delivered to you electronically.

3. Ownership & Intellectual Property

P-two 3 Studio retains no rights, ownership interest, access, or control over your purchased website files after delivery. We do not retain copies of your customised website for any purpose beyond the initial delivery and any agreed revision period.

P-two 3 Studio retains the right to use the underlying theme templates (not your customised version) for other customers. Your unique customisations, business content, and branding are exclusively yours.

4. Payment

• All prices are listed in Australian Dollars (AUD) and include GST where applicable.
• Payment is required in full before delivery of website files.
• We accept payment via PayPal, Square, credit/debit card, and bank transfer.
• All sales are final. See Section 7 for our refund policy.

5. Delivery

Website files are delivered electronically following receipt of payment. Delivery timeframes vary by package:

• Standard packages: Delivered within 24-72 hours
• Premium packages: Delivered within 24-48 hours (priority delivery)

Delivery is made via email or secure download link. Upon delivery, ownership transfers to you as described in Section 3.

6. Revisions

Each package includes a limited number of free revisions as specified at the time of purchase:

• Standard packages: 2 free revisions
• Premium packages: 3 free revisions

Revision requests must be submitted within 30 days of delivery. Additional revisions beyond the included amount are available at the published rate. A "revision" is defined as a reasonable set of changes submitted in a single request (e.g., text updates, colour changes, image swaps, minor layout adjustments).

Revisions are an optional service. Since you own the website files, you are free to make changes yourself or engage any third party to modify your website at any time.

7. Refund Policy

Due to the digital nature of our products and the immediate transfer of ownership upon delivery:

• All sales are final once website files have been delivered.
• If you are unsatisfied with the delivered product, you may use your included revisions to request changes.
• If we are unable to deliver the agreed product within 14 days of payment, you are entitled to a full refund.
• Refund requests for undelivered orders should be directed to our contact email.

8. Limitation of Liability

Once ownership transfers, the Customer assumes full responsibility for the website, its content, hosting, maintenance, security, and legal compliance.

9. Domain Names

Where a free domain name is included with your purchase:

• The domain is registered in your name and you are the sole owner.
• P-two 3 Studio facilitates registration but does not own or control the domain.
• Domain renewal after the first free year is your responsibility.
• Domain registration is subject to the terms of the chosen domain registrar.

10. Customer Responsibilities

As the Customer, you are responsible for:

• Providing accurate business information during the configuration process
• Ensuring all content you provide (text, images, logos) does not infringe on third-party rights
• Hosting, maintaining, and securing the website after delivery
• Compliance with all applicable Australian laws, including the Australian Consumer Law, Privacy Act, and any industry-specific regulations
• Renewing your domain name after the initial free period
• Maintaining backups of your website files

11. No Ongoing Relationship

The purchase of a website from P-two 3 Studio is a one-time transaction. Unless you separately purchase revision services or additional products:

• There is no ongoing service agreement, subscription, or retainer
• P-two 3 Studio has no obligation to provide updates, maintenance, or support after delivery and completion of included revisions
• P-two 3 Studio has no access to your website, hosting, or domain after delivery

12. Indemnification

You agree to indemnify and hold harmless P-two 3 Studio, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the delivered website
• Content you publish on the website
• Any breach of these Terms
• Any third-party claims related to your website

13. Privacy

We collect only the information necessary to fulfil your order (name, email, business details, payment information). We do not sell or share your personal information with third parties. Payment processing is handled securely by our payment providers (PayPal, Square). For details, see our Privacy Policy.

14. Dispute Resolution

Any disputes arising from these Terms will be governed by the laws of the Australian Capital Territory, Australia. Both parties agree to attempt to resolve disputes through good-faith negotiation before pursuing formal legal action. Any legal proceedings shall be conducted in the courts of the Australian Capital Territory.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Your purchase is governed by the Terms in effect at the time of your order.
